StreamersTip DMCA Policy
Effective Date: January 22, 2026
Last Updated: January 22, 2026
StreamersTip LLC ("StreamersTip," "we," "our," or "us") respects the intellectual property rights of others and expects everyone using our website, mobile app, and related services (collectively, the "Platform") to do the same. It is our policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and to terminate accounts of repeat infringers where appropriate.
This Policy explains how to submit a DMCA Takedown Notice, how users may file a Counter-Notification, how we handle repeat infringement, and how we process content removals and restorations.
1. Designated Agent for DMCA Notices
To notify us of alleged infringement, contact StreamersTip's Designated Agent:
Agent Name: Copyright Agent, StreamersTip LLC
Company: StreamersTip LLC
Email: [email protected]
Address: PO Box 1084, Winder, GA 30680, USA
Phone: [To be added]
Subject line: "DMCA Takedown Request"
2. What Qualifies as a Valid DMCA Takedown Notice
Your written notice must include all of the following (17 U.S.C. §512(c)(3)):
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Work Identified: Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works at one URL).
- Infringing Material Identified: Identification of the material claimed to be infringing or to be the subject of infringing activity, with reasonably sufficient information to locate it (e.g., specific URLs, profile name, post ID, timestamps).
- Contact Information: The complaining party's name, address, telephone, and a valid email address.
- Good-Faith Statement: A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy & Authority Statement (under penalty of perjury): A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is the copyright owner or authorized to act on the owner's behalf.
Important: Submitting a DMCA notice is a legal process. Knowingly making false claims may result in liability under §512(f), including damages and attorneys' fees.
3. How StreamersTip Handles Takedown Notices
Once we receive a facially valid DMCA notice:
- We will remove or disable access to the identified content.
- We will make a good-faith attempt to notify the uploader/creator (the "User") that the content has been removed, and we will forward a complete copy of your notice (including your contact information) to the User.
- We may request additional details if a notice is incomplete. If sufficient information isn't provided, we may be unable to act.
- In appropriate circumstances, DMCA-related actions contribute to our repeat-infringer evaluation (see Section 6).
4. Counter-Notification (How Users Can Dispute a Takedown)
If your content was removed in response to a DMCA notice and you believe the removal was mistaken or that you are authorized to use the content (e.g., license, fair use, public domain), you may submit a Counter-Notification under §512(g).
Your counter-notification must include:
- Signature: Your physical or electronic signature.
- Identification of Removed Material: Identify the content that was removed or disabled and the location where it appeared before removal (e.g., specific URLs, post IDs).
- Good-Faith Statement: A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Contact Information: Your name, address, telephone number, and email address.
- Jurisdiction & Service of Process Statement: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., for any judicial district in which StreamersTip may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
Send Counter-Notifications to: [email protected]
Subject line: "DMCA Counter-Notification"
What Happens Next
- If we receive a valid counter-notification, we will forward it to the original complainant.
- We will restore the content within 10–14 business days after receipt of the counter-notification unless the copyright owner notifies us that they have filed a court action seeking to restrain the User from engaging in infringing activity related to the material on StreamersTip.
- If we receive notice of such a lawsuit, the content will remain disabled pending court resolution.
5. Repeat-Infringer Policy
StreamersTip will, in appropriate circumstances, terminate accounts of Users who are determined to be repeat infringers. While specific thresholds may vary, factors include (without limitation):
- The number of valid DMCA notices received against the User's content,
- The severity and recency of violations,
- Whether the User successfully counters notices or provides licenses/permissions, and
- Evidence of intentional or systematic infringement.
We may also limit features, remove content, or suspend accounts while assessing infringement claims.
6. Misuse of the DMCA; Fair Use
The DMCA is not a tool to resolve non-copyright disputes (e.g., defamation, privacy, harassment) or to suppress lawful uses such as fair use (criticism, commentary, news reporting, teaching, scholarship, research, parody).
Parties who knowingly misrepresent that material or activity is infringing (or was removed by mistake) may be liable under 17 U.S.C. §512(f).
If you are unsure whether the material you are reporting is infringing, consult an attorney before submitting a notice.
7. Subpoenas and Account Information
StreamersTip may disclose account information pursuant to valid legal process, such as a subpoena, court order, or as otherwise required by law. We may notify affected Users where legally permissible.
8. Non-Copyright IP Complaints (Trademark, Right of Publicity)
This Policy covers copyright only. For trademark or right of publicity complaints, please email [email protected] with:
- The specific IP right asserted;
- Registration numbers (if any);
- Evidence of rights; and
- The URLs of allegedly infringing content.
9. Preservation, Transparency, and Record-Keeping
- We may preserve notices, counter-notices, and related correspondence to comply with legal obligations and to enforce this Policy.
- We may submit de-identified copies of DMCA notices to public archives such as the Lumen database, where appropriate and legally permissible.
10. Policy Updates
We may modify this DMCA Policy from time to time (e.g., due to legal or procedural changes). Updates will be posted with a revised "Last Updated" date. Material changes may be communicated via email or in-app notices.
